The Civil Code provides for a two-year residence period for nationals by origin of Ibero-American countries and other expressly specified cases. This does not mean that nationality is granted automatically after two years in Spain: the residence must meet certain conditions and the application requires evidence of other requirements.
Legal, continuous residence immediately before the application
For this route, adding up time physically present or registered with a municipality is not enough. It is necessary to check which periods constitute legal residence and how absences or interruptions affect them. A period of stay for studies should not simply be treated as residence for these purposes.
Nationality by origin and documentary status must be verified. Speaking Spanish or having lived in an Ibero-American country does not replace the legal requirement. Where there are multiple nationalities or previous changes, the documents should be reviewed individually.
What else must be established
The rules require good civic conduct and sufficient integration. Knowledge and language tests, as well as exemptions or dispensations, depend on the circumstances and applicable rules. Not everyone must provide exactly the same certificates.
Prepare an inventory of documents: identity, residence, foreign certificates and relevant supporting documentation. Check that names match, documents are valid, and translation or legalisation requirements are met. An omission may lead to a request for further information, while an incorrect document may require additional steps.
Submission and follow-up
Keep the submission receipt. You must also monitor the chosen notification method and respond to requests within the relevant period. Submitting an application is not equivalent to approval and does not allow a decision date to be promised.
If nationality is granted, further steps remain and must be completed in accordance with the applicable instructions and deadlines, including attendance to fulfil the requirements of Article 23 where relevant. The grant of nationality and the issue of Spanish documents are not the same act.
Frequently asked questions
Does marrying a Spanish national confer nationality?
Not automatically. Marriage may be relevant to a reduced residence period if its requirements are met, but it does not replace the application procedure.
Is the two-year period the time the Administration takes?
No. It is a residence requirement for certain applicants, rather than a guaranteed duration of the procedure.
Can I apply with only my municipal registration certificate?
Municipal registration does not replace proof of legal residence or the other documents required.
Our immigration and nationality service can review the chronology and documents before submission. This text does not determine whether your specific periods satisfy the requirement.
