Arraigo, residence based on ties to Spain, is not a single authorisation obtained simply by spending a certain amount of time in the country. The Immigration Regulations distinguish five categories: second opportunity, employment-based, social, training-based and family arraigo. Each requires its own circumstances and documents to be checked, alongside any applicable general requirements.
Choose the category before gathering documents
Second-opportunity arraigo relates to certain situations involving previous residence and failure to renew it. Employment-based arraigo requires an examination of employment contracts and their terms. For social arraigo, ties or integration and the other requirements of that route are relevant. Training-based arraigo concerns eligible training and the conditions required. Family arraigo applies to specific family situations, rather than every family relationship.
A relationship with a Spanish national or an EU citizen may also require another legal regime to be considered. Choosing a route by its name, without checking the legal circumstances, can lead to an unsuitable application.
Length of stay and administrative status
The required period must be checked for the specific category, under the current wording and transitional provisions. A historical municipal registration certificate may be useful, but does not by itself establish every requirement for an authorisation.
Previous authorisations, departures from Spain, earlier proceedings and, where relevant, status as an applicant for international protection must also be examined. It should not be assumed that every period counts in the same way.
How to organise the application file
Prepare a chronology of entries, departures and authorisations. Gather your passport, documents concerning your time in Spain, previous decisions and evidence of any relevant ties, contracts or training. Check validity, legalisation or apostille and translation requirements for foreign documents where required.
Forms, fees and submission channels must match the actual procedure. Check that information is consistent across documents and that you have a notification channel you can access. Submitting numerous files does not make up for a missing essential requirement.
After submission
Keep the submission receipt and check notifications. A request may ask for explanations or documents within a specific period. Applying, receiving approval, giving fingerprints and having a card issued are separate steps: they should not be confused when planning travel or work.
Frequently asked questions
Do two years of municipal registration guarantee arraigo?
No. Time spent in Spain is only one possible issue and must be checked alongside the category and the remaining requirements.
Does any course qualify for training-based arraigo?
This should not be assumed. The type of eligible training, its accreditation and the conditions of the application must be checked.
