Road traffic accident lawyer in Barcelona
After an accident, your health comes first. Once your condition stabilises, we help ensure compensation reflects what you have suffered —injuries, lasting effects, time off and expenses— and support you in negotiations with the insurer or in court. We also defend traffic cases: drink-driving, serious fines and driving-licence disqualification.
At a glance
- Compensation is calculated using the statutory scale, with amounts updated annually (by 2.9% in 2026).
- Do not sign the insurer's final settlement or accept an offer before the lasting effects are known.
- Claim deadlines are short: do not wait until treatment ends before seeking information.

What to do after an accident
Actions in the first few hours often shape the subsequent claim.
- Call 112 if anyone is injured and do not move anyone who may be hurt.
- Complete the joint accident report with both drivers' details and photograph the vehicles, road and signs.
- Attend emergency care even if you feel well: the initial medical report documents injuries.
- Keep sick notes, reports, invoices and expense receipts.
- Do not sign anything from the insurer without reviewing it.
What compensation may include
The statutory scale distinguishes categories. A complete claim assesses them all.

Lasting effects
Impairment points, disfigurement and their impact on everyday life and work.

Medical and travel expenses, and lost earnings.
Death

Deadlines and points to bear in mind
- Deadline for claiming
- In many cases it is one year from medical discharge or stabilisation of lasting effects, but this may vary with the route and applicable law. Seek advice promptly.
- Reasoned offer
- The insurer must respond to your claim with a reasoned offer or response within three months.
- Tax
- Generally, personal-injury compensation within the statutory scale's amounts is exempt from personal income tax (IRPF).
- Alcohol at the wheel
- Driving under the influence of alcohol can be a criminal offence even below 0.60 mg/l in exhaled breath. Article 379.2 of the Criminal Code covers, in any event, driving above that limit. Classification and possible expedited proceedings depend on the facts and legal requirements, not solely on a range of alcohol readings.
Frequently asked questions
How long do I have to claim after a road traffic accident?
It depends on the route and the case. As a guide, the usual period is one year from medical discharge or determination of lasting effects, although it may vary. It is therefore advisable to seek advice before treatment ends, not afterwards.
What compensation am I entitled to?
It depends on injuries, lasting effects, recovery time, your age, income and the accident's circumstances. The scale assigns amounts by category, and an expert medical report is often crucial. We give a reasoned estimate after reviewing the documents, without promising figures beforehand.
Should I accept the insurer's first offer?
Not without reviewing it. Offers are often made before lasting effects are known or without including every category. If you accept and sign a final settlement, you will usually be unable to claim more.
What if there is no police report or the other driver is uninsured?
The accident can be evidenced through the joint report, photographs, witnesses and medical reports. If the responsible driver is uninsured or unidentified, the Insurance Compensation Consortium may intervene.
Can pedestrians and cyclists claim?
Yes. Pedestrians and cyclists injured by a motor vehicle are covered by the same statutory compensation system.
What should I do if alcohol has been detected while driving?
Seek a lawyer promptly: expedited proceedings and administrative penalties have short deadlines. We assess evidence (device calibration and intervals between tests), possible agreement to the charge and consequences for your licence.
How are fees paid?
We agree them in writing before starting, according to the type of matter, and explain them clearly at the initial consultation.
