An Immigration Office request must be read alongside the application and documents already submitted. First identify what is being requested, when it was notified and the response deadline. Sending separate files without explaining which issue they remedy is not advisable.
Review the complete notification
Keep the document and evidence of notification or electronic access. The date an email alert is received must not be confused with the date that has legal effect. Where there is a representative, check who receives notifications and how any issues will be communicated.
The general rule on remedying deficiencies in Article 68 of Law 39/2015 provides for ten days, calculated as applicable and subject to special rules. Do not apply that number automatically to every request: read its legal basis and content.
Respond point by point
Prepare a short list of what is requested and the document supplied for each point. Check identity, application reference and procedure. If the problem concerns differing names, dates or details across documents, explain the discrepancy with documentary support.
Check file format, legibility and completeness. A cropped certificate, a document without a required translation or one lacking the relevant formalities may not remedy the deficiency. Keep an exact copy of the response submitted.
If a document does not arrive in time
Waiting for a foreign certificate does not automatically extend the deadline. The permitted options, available justification and, where appropriate, the possibility of requesting an extension before the deadline must be considered. A request for an extension should not be treated as automatically granted.
Do not provide false documents or replace a requirement with a statement that does not have the required effect. If compliance is not possible, the actual impact on the application and lawful alternatives need to be assessed.
Prove submission
Use a channel accepted for the procedure and keep the receipt, date, registration number and attachments. Afterwards, check for further notifications. A screenshot of prepared files is not equivalent to registering the response.
Failure to remedy deficiencies may result in the application being treated as withdrawn when the requirements are met and the relevant decision is issued. Nor should an absence of news be interpreted as approval without examining the rules on administrative silence for the procedure.
Frequently asked questions
Does an email to the firm or an appointment stop the deadline?
No. The appropriate administrative steps must be taken within the time available.
Can I resend the entire application without explanations?
It is advisable to identify how each deficiency is remedied; repeating files does not guarantee an adequate response.
Consult our immigration and nationality service with the full notification. This guide does not calculate your deadline or replace a review of the request.
