The Spanish payment order procedure (procedimiento monitorio) can be used to recover certain documented monetary debts. Having an invoice helps explain the claim, but does not by itself establish that every amount is due or that this procedure is always the appropriate route.
The initial review should identify the debtor, the origin of the debt, its due date and the documents connecting the amount to services or goods actually supplied. It is also useful to check whether there is a dispute about what was delivered or the price.
Documents worth gathering
Prepare the contract or accepted quotation, invoices, delivery notes, proof of delivery and relevant correspondence. Any partial payments, credits or changes in scope should be reflected so that the amount claimed still matches the actual outstanding balance.
An organised file helps identify errors in identification, amounts not yet due or differences between the company that contracted and the one that received the invoice. Simply increasing the number of documents does not resolve these problems.
Lawyers and court representatives: distinguish each stage
Spain's Civil Procedure Act does not require a lawyer or a procurador (court representative) to submit the initial payment order application, regardless of the amount. This rule should not automatically be extended to an objection or subsequent enforcement.
Professional assistance can be useful before filing to review the debt, the competent court, preliminary requirements and the strategy if the debtor disputes the amount. The fact that assistance is not mandatory at the outset does not mean the procedure is risk-free.
What may happen next
The debtor may pay, object or fail to respond to the demand. Each response leads to different steps. A reasoned objection may move the dispute to the appropriate proceedings; a failure to respond does not mean the creditor automatically receives money.
Before making a claim, the realistic prospect of recovery should also be assessed. A favourable decision and the debtor's solvency are separate issues. Available information about assets, business activity or ongoing proceedings may influence the decision.
Prior demands and negotiation
It is necessary to check whether prior negotiation is required under current procedural law and how to evidence it. Not every invoice reminder or burofax satisfies, by itself, all the requirements for an appropriate dispute resolution method.
Evidence of a demand and the confidentiality rules governing negotiations also need separate treatment. Both issues should be prepared before proposals are exchanged.
Frequently asked questions
Can I claim interest as well as the debt?
This depends on the contract, the transaction and the applicable rule. The calculation should identify the principal, the period and the relevant rate, without automatically adding items.
Does an unsigned invoice always prevent use of the payment order procedure?
There is no universal answer. The law provides for different documents, and the entire contractual relationship and the available evidence must be assessed.
