The road traffic compensation scales distinguish different losses and require a connection with the accident. Compensation for injuries is not calculated simply by multiplying every day of sick leave by an amount: the recovery period, the loss suffered, permanent consequences and any applicable economic damage must be identified.
Temporary injuries and permanent consequences are different concepts
Temporary injuries are assessed during recovery or until stabilisation. Permanent consequences are effects that remain after that process and require specific assessment. Having discomfort does not allow someone to assign themselves a permanent-injury score.
Sick leave, discharge by an insurer and stabilisation of injuries are not necessarily equivalent documents. It is useful to analyse what each establishes and whether there are justified differences between medical assessments.
Why not every day is treated in the same way
The system distinguishes basic personal loss and certain particular losses according to their requirements. Classifying a period requires evidence of actual limitations, rather than simply counting rehabilitation sessions or days away from work.
It is useful to organise reports by date and describe the activities affected. Circumstances predating the accident must also be studied to distinguish their influence from the accident’s consequences. Documentation must faithfully reflect what happened and must not exaggerate symptoms or limitations.
Which expenses and income to document
Keep invoices, proof of payment and prescriptions where available. Payslips, business records and information enabling a comparison of circumstances may be relevant to lost income. An unsupported estimate does not replace evidence of economic damage.
The analysis must avoid double counting and distinguish expenses, loss of earnings and personal loss. Each item has its own conditions and calculation method.
Which table should be used
The accident date, applicable legislation and rules on financial updates must be reviewed before quantifying a claim. This is why this article does not give daily amounts or point values converted into euros as though they applied to every accident in 2026.
A useful review sets out the items separately, the documentary basis for each and any disagreement with the insurer’s proposal. That explanation helps assess negotiations on a better-informed basis.
Frequently asked questions
Does all rehabilitation give rise to days of particular loss?
Not automatically. The loss established in each period must be assessed against the legal criteria.
Does a calculator replace a medical report?
No. It may help calculate using data already established, but it does not itself establish causation, permanent consequences or the category of each loss.
