An effective banking complaint should make it possible to identify the transaction, the disputed issue and the solution requested. For a business, preparing this file prevents the exchange from becoming a series of generic messages without documents or a defined request.
The first step is to distinguish whether the aim is to correct a charge, clarify an account statement, report conduct or negotiate new terms. These objectives may require different routes and do not necessarily have the same effects.
Explain the problem in a short chronology
Arrange the facts by date and link each one to its supporting document. Identify the company or professional making the complaint, the contract and the amounts affected. A representative must be able to establish their authority when required.
It is preferable to separate facts, reasons for disagreement and the requested outcome. If the problem is a fee, specify which one; if it is a transfer, describe the transaction and communications received. Do not include unnecessary business or personal information.
Keep evidence of submission
Keep a copy of what was submitted and proof that it was received through the appropriate channel. Note the assigned reference and responses. A conversation at a branch may be useful, but should not be the only evidence of the complaint.
If you receive a request for documents, review what is being requested and how to respond. Sending the entire file again without identifying what each item proves may make the matter harder to understand.
There is no single time limit for every complaint
The applicable time limit should be checked according to the service, the capacity in which the customer is complaining and current legislation. Payment services have a specific regime. The adaptation period for the customer service legislation approved in 2025 must also be taken into account.
For that reason, it is not prudent to treat a number of days taken from an earlier complaint as a permanent rule. The submission date and relevant rule should be recorded for the particular case.
What the supervisor can do and what requires another route
If no response is received within the applicable period, or it is unsatisfactory, the possibility of complaining to the competent supervisor should be assessed. Jurisdiction depends on the product and the complaint's subject matter: not every financial dispute falls within the Bank of Spain's remit.
Its intervention does not replace every possible court action or turn a report into an enforceable judgment. If the objective requires a contractual declaration, compensation or urgent measures, the appropriate routes and requirements must be assessed.
Frequently asked questions
Does complaining to the bank automatically halt court proceedings?
This should not be assumed. If proceedings are ongoing, their time limits require separate attention and coordination with any negotiation or complaint.
Must I accept the solution offered by the institution?
Before accepting, review its scope, especially if it includes waivers, a full and final settlement or new guarantees. A partial solution may affect the remainder of the dispute.
Our banking disputes service for businesses can help organise the documentation and assess the appropriate route. This is general information and does not determine the time limit, jurisdiction or outcome of an individual complaint.
