Before accepting an inheritance, it is advisable to understand the assets, debts and applicable succession law. Dealing with taxes and accepting the inheritance are related but separate matters. Tax urgency should not lead to signing or disposing of assets without understanding the civil-law consequences.
Identify who can inherit and which law applies
The death certificate, certificate of last wills and the will, if one exists, are a starting point. If there is no will, a declaration of heirs may be necessary. A property located in Catalonia does not by itself determine every rule governing a succession.
Personal circumstances and, where there are international elements, the relevant rules must be reviewed. Account balances or assets should not be distributed based on an assumption about who is an heir.
Make an inventory before acting
Gather information about properties, accounts, loans, guarantees, tax obligations and other commitments. An account balance does not necessarily represent the net value of the estate. There may also be expenses or claims that need to be checked.
Acceptance and renunciation have effects that must be examined. Certain acts involving assets may be relevant in assessing whether acceptance has occurred. Options for protection against debts, including acceptance with benefit of inventory where appropriate, require their conditions and deadlines to be met; writing that expression in an informal document is not enough.
Keep the tax timetable separate
For inheritances subject to inheritance tax administered by the Catalan Tax Agency, the general filing period is six months from the date of death. An extension must be requested within the first five months and has effects and interest costs in accordance with its rules.
A tax extension does not automatically extend every civil-law deadline or replace a decision about the inheritance. It is also necessary to check for other obligations, such as taxes linked to real property, and which authority is competent.
Tax reliefs and distribution
Not all heirs qualify for the same reliefs. Family relationship, pre-existing wealth, assets, retention requirements and other circumstances may change the outcome. Avoid calculating tax by applying a general relief to every case.
Distribution must coordinate allocations with charges, other people's rights and taxation. Differences between values in documents and values required for tax purposes also need to be reviewed.
Frequently asked questions
Can I request an extension after six months?
Do not assume this is possible: the ordinary extension request has its own earlier deadline.
Does acceptance always mean the same liability for every debt?
The consequences depend on the acceptance regime and its requirements. These should be examined before taking action involving the estate.
Consult family and inheritance with the documents available. This information does not determine the applicable law or your tax liability.
